In this book G. A. Cohen examines the libertarian principle of self-ownership, which says that each person belongs to himself and therefore owes no service or product to anyone else. This principle is used to defend capitalist inequality, which is said to reflect each person's freedom to do as as he wishes with himself. The author argues that self-ownership cannot deliver the freedom it promises to secure, thereby undermining the idea that lovers of freedom should embrace capitalism and the (...) inequality that comes with it. He goes on to show that the standard Marxist condemnation of exploitation implies an endorsement of self-ownership, since, in the Marxist conception, the employer steals from the worker what should belong to her, because she produced it. Thereby a deeply inegalitarian notion has penetrated what is in aspiration an egalitarian theory. Purging that notion from socialist thought, he argues, enables construction of a more consistent egalitarianism. (shrink)

The physicist–philosopher Philipp Frank’s work and influence, especially during his last three decades, when he found a refuge and a position in America, deserve more discussion than has been the case so far. In what follows, I hope I may call him Philipp – having been first a graduate student in one of his courses at Harvard University, then his teaching assistant sharing his offices, then for many years his colleague and friend in the same Physics Department, and finally, (...) doing research on his archival holdings kept at Harvard. I also should not hide my large personal debt to him, for without his recommendation in the 1950s to the Albert Einstein Estate, I would not have received its warm welcome and its permission, as the first one to do historical research in the treasure trove of unpublished letters and manuscripts, thus starting me on a major part of my career in the history of science. The claim that moral responsibility requires relevant alternative possibilities is encapsulated by the following principle: PAP: A person is morally responsible for what he has done only if he could have done otherwise. In 1969 Harry Frankfurt devised what purported to be a counterexample to PAP: Suppose someone, Black, let us say, wants Jones to perform a certain action. Black is prepared to go to considerable lengths to get his way, but he prefers to avoid showing his hand unnecessarily. So (...) he waits until Jones is about to make up his mind what to do, and he does nothing unless it is clear to him that Jones is going to decide to do something other than what he, Black, wants him to do. If it does become clear that Jones is going to decide to do something else, Black takes effective steps to ensure that Jones decides to do, and that he does do, what he, Black, wants him to do. Whatever Jones's initial preferences and inclinations, then, Black will have his way. . . . Now suppose that Black never has to show his hand because Jones, for reasons of his own, decides to perform and does perform the very action Black wants him to perform. In that case, it seems clear, Jones will bear precisely the same moral responsibility for what he does as he would have borne if Black had not been ready to take steps to ensure that he do it. It takes into account the influence of Abel Rey and V. I. Lenin, considering the idea of the “bankruptcy of science.”.

According to Saul Smilansky's ‘Paradox of Beneficial Retirement’, many serving members of professions may have decisive integrity-based reasons for retiring immediately. The Paradox of Beneficial Retirement holds that a below-par performance in one's job does not require any outright incompetence, but may take a purely relational form, in which a good performance is not good enough if it would be improved upon by someone else who would be appointed instead. It is argued, in response, that jobs in the sectors (...) Smilansky mentions are not merely positions to optimize the goals of the profession, but are professional careers in which there is the possibility of security and personal fulfilment. The article also explores connections between Smilansky's argument and G. A. Cohen's anti-incentives argument against Rawls. It is suggested that both thinkers underappreciate the relationship between personal reasons and institutional reasons. (shrink)

While the rule of law is surely a very important good, the familiar discussions found in the literature lead many to conclude that it is either a relatively trivial political ideal, or else a redundant one. What is needed is a new and persuasive defense of the rule of law that properly reflects its great significance for human well being. An important step towards building such an argument is to question a widely-shared but often unnoticed assumption that the rule (...) of law should be understood as a virtue of legal systems. The path is then cleared for a republican argument built on two theses: first, the thought that an ideal society would be one in which no one is the master of anyone else, and second, the thought that our freedom from domination is not natural or pre-institutional. This article is a follow-up to a previous one in Moreana 51, which provided a detailed analysis of the immediately preceding 464-word sentence. The two sentences placed near the end of Utopia I work together to illustrate the political wisdom which the fictional Hythlodaeus has acquired in his travels, and at the same time encourage readers of Utopia to look forward to, and to accept the wisdom of the Utopians way of life as a positive model for Europe. There is (...) an undoubted harmony between the sensible practices of the “Achorians” and “Macarians” and More's political philosophy as revealed in his epigrams. Nevertheless, the two long sentences also function as praeambula to the full-length account of the Utopians, and they are meant to guide our interpretation. The details of their structure, here analyzed, bring about certain rhetorical effects. In a crescendo of irony, the long sentences establish a rather peculiar character for Hythlodaeus as the sole narrator of Utopia II: he is an independent, utterly frank witness to this fictional “reality” of More's creation, and by the end of Utopia I we readers are prepared to listen to Utopia II with very critical ears indeed. The rule of law is a valuable human achievement. It is valuable not only instrumentally, but also for its own sake as a significant aspect of social justice. Only in a society that enjoys the rule of law is it possible for people to regard one another as fellow free citizens; no one the master of anyone else. Nevertheless, the rule of law is poorly understood. Buddhism has become one of the main dialogue partners for different psychotherapeutic approaches. As a psychological ethical system, it offers structural elements that are compatible with psychotherapeutic theory and practice. A main concept in Mahāyāna-Buddhism and postmodern psychoanalysis is intersubjectivity. In relational psychoanalysis the individual is analysed within a matrix of relationships that turn out to be the central power in her/his psychological development. By realising why one has become the present individual and how personal development is connected with relationships, (...) the freedom to choose and create a life that is independent from inner restrictions should be strengthened. In Mahāyāna-Buddhism, intersubjectivity is the result of an understanding of all phenomena as being in interdependent connection. Human beings are a collection of different phenomena and in constant interchange with everything else. Personal happiness and freedom from suffering depends on how this interchange can be realised in experience. The article focuses on the philosophical psychological fundaments in both approaches and emphasises clarification of to what the term ‘intersubjectivity’ exactly refers. This clarification is essential for the current dialogues, as well as further perspectives in this interdisciplinary field. (shrink)

It is not about CogNovo, the interdisciplinary and international doctoral training programme that produced three different Off the Lip events. It is not about Off the Lip 2017, the novel symposium format we developed to collaboratively create a publication resulting in this special issue of AVANT. It is not about the seemingly heterogeneous collection of papers that follow this preface. Collaborative Approaches to Cognitive Innovation required something else, something we (...) are starting to capture in the four GIFT principles. While this special issue is not solely about CogNovo, Off the Lip events, or the content of the following submissions, all these aforementioned elements were necessary to shape our current understanding of Cognitive Innovation, the very process which led to numerous publications, exhibitions, and events during the past three years. In a sense, all of our previous endeavours have culminated in this collection of 26 distinct pieces of work, yet we hope and believe that this special issue also marks a beginning. Let us explain. Certain artworks are––whatever else they are––statements about the value of art. A particularly striking form of such a statement is made by a class of artworks we can call “high-cost art.” High-cost artworks are those with greater costs relative to benefits for their artists or displayers. I will argue here that those art forms that are most likely to include high-cost works are particularly effective at communicating artistic value-claims, and suggest that by so championing the value of art, these (...) artworks themselves increase in artistic value. John Dewey's Experience and Education is an important book, but first-time readers of Dewey's philosophy can find it challenging and not meaningfully related to the contemporary landscape of education. Jeff Frank's Teaching in the Now aims to reanimate Dewey's text--for first-time readers and anyone who teaches the text or is interested in appreciating Dewey's continuing significance--by focusing on Dewey's thinking on preparation. Frank, through close readings of Dewey, asks readers to wonder: How much of what we justify as (...) preparation in education is actually necessary? That is, every time we catch ourselves telling a student--you need to learn this in order to do something else--we need to stop and reflect. We need to reflect, because when we always justify the present moment of a student's education in terms of what will happen in the future, we may lose out on the ability to engage students' attention and interest now, when it matters. Dewey asks his readers to trust that the best way to prepare students for an engaging and productive future is to create the most engaging and productive present experience for students. We learn to live fully in the future, only by practicing living fully in the present. Although it can feel scary to stop thinking of the work of education in terms of preparation, when educators reclaim the present for students, new opportunities--for teachers, students, schools, democracy, and education--emerge. Teaching in the Now explores these opportunities in impassioned and engaging prose that makes Experience and Education come alive for readers new to Dewey or who have taught and read him for many years. English summary: It was not until the publication of Schelling''s Munich and Berlin lectures that we learned the decisive source for his theory of an identity of identity or identity doubled in itself. Schelling referred to what he called an older logic that was still acquainted with the figure of reduplication, for instance in Leibniz and Wolff. Philosophers in this tradition employed this term to refer to the specification of an aspect under which the subject-term is being considered. An often (...) quoted example: As consul, Fabius Maximus has authority over his father, but as son he stands under his fathers authority. Schelling gave the following turn to reduplication: Nature as nature does not coincide with the mind; and the mind as mind does not coincide with nature. Both have different truth conditions, so as to integrate an essential moment of difference into the identity formula. There is an X, however, which is strictly (seamlessly) identical with itself (the absolute subject = X) while transitively being both of them in turn; and it is only via X that the relata (nature and mind) are indirectly identified with each other: X is B and X is A (and X is strictly identical to itself). In addition to this, Schelling held a view of predication as kind of identification. He became acquainted with this view at the Tubingen Seminary through his teacher Gottfried Ploucquet. This insight helps us understand why Schelling reasonably thought that the identity-formula A=A is the genuine matrix of all veridical judgments. Taken together with his conviction that judging (Kant''s relative position) is a minor (or inferior) form of existential being (Kant''s absolute position) sheds light on why in 1806 Schelling made the radical contention in his Aphorisms: The strict sense of being (absolutely posited seamless self-sameness) is taken over by the looser sense of the copulative is which identifies subject and predicate; yes, this copula alone is existence itself and nothing else. Why should Schelling''s conception of nature-mind identity interest recent philosophers of mind? Because Schelling presents an ontologically neutral solution: Identity is a symmetrical relation that does not favor mind or matter, and prevents the idealistic reduction of nature to the mind. Nor can we conceive of the nature-mind identity as a fact inwardly disclosed to the mind (McGinn, Levine). Consciousness remains an enigma for itself; so does its identity with nature. Schelling teaches us that identity theories are not justified by self-evidence, but by an inference to the best explanation. German description: Nie ist genau erklart worden, was Schelling unter Identitat von Natur und Geist verstand. Dabei hat er sein reifes Denken Identitatssystem genannt und sich zeitlebens um kein zweites Problem begrifflich ahnliche Muhe gegeben. Es sind erstens die Identitatstheorie der Pradikation seines Universitatslehrers Ploucquet, die den Stiftlern in Tubingen eingeblaut wurde und die ihre merkwurdige Fixierung auf die ganz unkantische Auffassung vom Urteil als Subjekt-Pradikat-Identifikation (mit quantifiziertem Pradikator) erklart. Und zweitens Schellings Entdeckung einer alteren Logik, die mit der Figur der reduplicatio arbeitete. - So auch das Absolute: Als Geist ist es nicht Natur (und umgekehrt; Aussagen uber beide haben unterschiedliche Wahrheitsbedingungen), aber Geist und Natur werden beide vom Absoluten gewesen (transitiv ins Sein gehoben), und dies Absolute ist im striktest denkbaren Sinne mit sich identisch. So lasst sich die Schelling''sche Formel von der Identitat der Identitat und Differenz dem gesunden Menschenverstand vermitteln und Schellings aufrichtiger Jugendgedanke (Marx) aktualisieren. When we have asked Hadza whether married couples should live with the family of the wife (uxorilocally) or the family of the husband (virilocally), we are often told that young couples should spend the first years of a marriage living with the wife’s family, and then later, after a few children have been born, the couple has more freedom—they can continue to reside with the wife’s kin, or else they could join the husband’s kin, or perhaps live in a (...) camp where there are no close kin. In this paper, we address why shifts in kin coresidence patterns may arise in the later years of a marriage, after the birth of children. To do so, we model the inclusive fitness costs that wives might experience from leaving their own kin and joining their husband’s kin as a function of the number of children in their nuclear family. Our model suggests that such shifts should become less costly to wives as their families grow. This simple model may help explain some of the dynamics of postmarital residence among the Hadza and offer insight into the dynamics of multilocal residence, the most prevalent form of postmarital residence among foragers. Western intellectual tradition is brought to focus through the lens of Dante’s Comedia around the idea of the identity of being and intellect. All reality is dependent on God as pure Being, pure actuality of self-awareness (“thought thinking itself ”); everything else is or,equivalently, has form by its participation in this Being which is Intellect. Modern scholarship on decision behavior dates from the late 1940s. But that scholarship has been preoccupied with two ideas that are much older. One is the notion of expected utility, first articulated in the scholarly literature by Daniel Bernoulli in 1738. In its simplest form, the expected utility concept applies to monetary gambles. Imagine you are asked to choose between two gifts, either gamble G, which you would then play and get either $9 or nothing, or else a simple, (...) direct payment of $3. As shown in the decision tree in figure 10.1, you receive gamble G's $9 payoff if the toss of a fair die yields one or two pips, but you receive nothing otherwise. (In decision trees, choice points are represented by square nodes, chance points by circular nodes.) The expected value or expectation of a gamble is the sum of its payoffs, each weighted (i.e., multiplied) by its probability. Thus, the expected value of G is EV(G) = (1/3)($9) + (2/3)($0) = $3, the same as the direct payment. So, if you generally make decisions like this one so as to maximize expected value, you would be indifferent between the present options. However, if you are like most people, you are not indifferent. Instead, you are risk‐averse, preferring the guaranteed $3. Why? (shrink)

Establishing acceptable norms of behavior and consistent standards of conduct has been part of the human enterprise since the dawn of time. Without principles of ethics and the moral rules that affect individual behavior, humankind would plunge into a state of chaotic indifference, insecurity, and unending fear. But while few question the need for moral guidance, a growing number of people believe that the only ethic worth considering must rest on a biblical foundation. Is morality dependent upon God and "revealed (...) truths" found in scripture? Must this claim be accepted without question lest we risk the torment of eternal damnation for questioning it? Without critical evaluation and careful scrutiny, there is little hope of distinguishing truth from unfounded belief. How valuable is the Bible as a source for ethical truth? Do the scriptures truly have the insight needed to guide humankind safely through the moral dilemmas of modern society? What constitutes a biblical ethic? Should the Bible be construed as the only basis for moral teaching? Is it really the final authority on moral issues, or are there secular alternatives that can serve as guides to acceptable conduct within the human community? A distinguished group of social philosophers, biblical scholars, and ethicists met at the University of Richmond, Virginia, under the aegis of the Committee for the Scientific Examination of Religion and its Biblical Criticism Research Project, to address these and related questions. The essays in this provocative work demonstrate a diversity of perspective and breadth of insight that will shed much needed light on the nature of ethics. - And what is the public interest? - That's for politics to decide! - Does that mean that the public interest is the interest of politicians? - It may seem that way, but this is a democracy. It's really the people that decide about the public interest. The politicians merely fill in the details after the voters have set down the broad outlines. That's why it is important that you vote in the next election. Your vote counts as much any (...) man's. - I do not doubt that it does, but how much does any man's vote count? Politicians make all sorts of statements. Their programs are complex packages in nice wrappers, sealed until after the election. We can only vote on vague promises, without knowing which ones, if any, the Elect intend to keep. And when the votes are in, the elected politicians decide what our vote meant. Give us a note, they say, and we'll turn it into a symphony. What nonsense! Why should I vote if somebody else determines the meaning of my vote? Voting is like writing a blank cheque. - Hmm, I see. In lieu of an abstract, here is a brief excerpt of the content:Book Reviews Catherine Osborne. Rethinking Early Greek Philosophy: Hippolytus of Rome and the Presocratics. London: Duckworth, 1987. Pp. viii + 383. NP. A quick look at Kirk, Raven, and Schofield's standard The PresocraticPhilosophers(Cambridge University Press, 1983) or Barnes's recent Early GreekPhilosophy (Penguin, 1987) reveals a clear distinction between (a) direct quotations (ipsissima verba) of the Presocratics and (b) testimonia (doxographic or otherwise) about their thought. This bifurcation into original (...) fragments and testimonia is called into question by Osborne in her book. For Osborne, the standard procedure of identifying fragments within a larger context and then interpreting the fragments without reference to that context is to be put aside "in favour of reading the text of the Presocratics as embedded texts within the context of the interpretations they were selected to illustrate" (183). This new methodology is not offered by Osborne as applicable across the board, for all the Presocratics. It is a nonstarter for, say, Parmenides, for whom we have (obvious) verbatim quotation in Simplicius (and consequently no need to take into account the Simplician context). But in the case of some other Presocratics we are not on such secure grounds. Or so Osborne thinks, and the book illustrates her hermeneutical principles with reference to Heraclitus and Empedocles as their thought is embedded in the text of Hippolytus of Rome's Refutation of All Heresies. Osborne's strategy proceeds in two distinct stages: (1) She first offers us a couple of examples of Hippolytus's interpretive skills, both of which, in different ways, reveal him as a pretty reliable (if biased) and interesting philosophical and textual exegete. In this regard she presents Hippolytus's discussion of Aristotle's doctrine of substance in the Categoriesand Metaphysics Z (in the context of Hippolytus's refutation of the heretic Basileides) and, secondly, his reworking of Irenaeus's life of Simon Magus, the reputed founder of gnosticism. Aristotle is a particularly good test case because we can, of course, check Hippolytus's report against the original. Having done so, Osborne is led to conclude that "little of interest can be derived from the limited amount of material that is quoted directly from Aristotle" (183; cf. also 66). Nonetheless, for Osborne comparison with Aristotle's text reveals Hippolytus as not bereft of philosophical acumen, even though his interpretation is colored by the particular polemics in which he is engaged. In sum, then, Osborne understands Hippolytus as an intelligent (if biased) interpreter of Aristotle and not a particularly good source for ipsissimaverba. (2) On the basis of these conclusions about Hippolytus as a source for Aristotle's metaphysical theory and for the life of Simon Magus, Osborne turns to Hippolytus's discussion of Heraclitus and Empedocles (in the context of his refutations of the [ll9] 120 JOURNAL OF THE HISTORY OF PHILOSOPHY 28"1 JANUARY ~99 o heretics Noetus and Marcion). Her goal is to urge a new nonfragment-based methodology for the study of the Presocratics, grounded in the conclusions she has just reached about Hippolytus as an interpreter of Aristotle and Irenaeus. The major obstacle which she faces in validating such a methodology is that in the cases of Heraclitus and Empedocles we have no original text by which to judge Hippolytus's reliability or interpretive skills. In lieu of such original texts all that Osborne has at her disposal is her own conclusion just reached about Hippolytus as a generally reliable (if biased) interpreter of Aristotle and Irenaeus. But just here is the major problem with Osborne 's proposed methodology: granting for the sake of argument that Hippolytus is a pretty good interpreter of Aristotle and Irenaeus, this does not entail that he is a reliable exegete of anyone else. He might be, he might not. We don't know and, more importantly, we have no way of finding out. Osborne assumes that Hippolytus had a greater knowledge of the relevant texts than we do (67, 185), and thus interpreted the Presocratics on this basis. He might have, he might not. In any event, Osborne's assumption is a case of special pleading. Equally plausible is that Hippolytus possessed no more of Heraclitus or Empedocles than we do and, consequendy, had... (shrink)

Institutions are normative social structures that are collectively accepted. In his book Making the Social World, John R. Searle maintains that these social structures are created and maintained by Status Function Declarations. The article’s author criticizes this claim and argues, first, that Searle overestimates the role that language plays in relation to institutions and, second, that Searle’s notion of a Status Function Declaration confuses more than it enlightens. The distinction is exposed between regulative and constitutive rules as being primarily a (...) linguistic one: whereas deontic powers figure explicitly in regulative rules, they feature only implicitly in constitutive rules. Furthermore, he contends that Searle’s collective acceptance account of human rights cannot adequately account for the fact that people have these rights even when they are not recognized. Finally, It is argued that a conception of collective intentionality that involves collective commitment is needed in order to do justice to the normative dimension of institutions. (shrink)

Graff's second point about formalism does not refute my argument that the New Critics upheld the coherence or organicity of a work of art and yet did not ignore its relation to reality. I argued this to be a defensible view also from a parallel with painting. The individual New Critics emphasized one or the other side, in different contexts, and I am not prepared to defend the clarity and consistency of every one of their pronouncements. But even the loosely (...) phrased quotation from Allen Tate's essay "Narcissus as Narcissus" can be defended. In saying that "it [Tate is discussing his own "Ode to the Confederate Dead"] is not knowledge 'about' something else," he means that the poem does not make statements about the solipsism and narcissism that he discusses later. "The poem is rather the fullness of that knowledge"; that is, it is a creation, a new thing which has its meaning as a totality, and that meaning surely refers to the outside world: the cemetery, the dead, the Civil War, and so on. . . . To judge from Graff's book, Poetic Statement and Critical Dogma, we are not so far apart in our estimate of the New Criticism. I also have my troubles , mainly with their psychologism and the dichotomy between emotional and propositional language, but on the points that I discussed in the article—the supposed lack of historical outlook, aestheticism, formalism, and scientism—the New Criticism, has often been misunderstood and misrepresented. It needs and deserves the rehabilitation I have attempted.
